It’s the other way around in the EU countries. The criterion of the economically soundest bid is used in 78% of cases, and the criterion of the lowest price in only 22%. Practice has shown that the criterion of the lowest bid is suitable for procurement of highly standardized and simple goods, while in the procurement of complex goods and services, in addition to prices, it is necessary to use other elements of evaluation.
Traffic Safety Agency of Serbia has recently announced a tender for the supply of integrated marketing communications. In addition to the lowest price being stated as the sole criterion for the selection of the winning bidder, and not the value of the creative idea and the creative solution – I mean, what do people who purchase screws, fuel and lubricants for cars know about creativity – the tender abounds with rigged conditions. The only thing missing is the logo of the agency for which it was published. This is one in a series of stupidly rigged tenders that agencies in the region face almost daily. But this one has surpassed many of its peers.

III-2 ADDITIONAL REQUIREMENTS (Article 76. ZJN)
The bidder must meet the following additional requirements to participate in this procurement procedure:
1. The bidder has not been insolvent in the last 36 months prior to the publication of this public call for proposals.
2. In the last two financial years (2014 and 2015), the bidder has achieved operating revenues of at least 14 million dinars per year. (€113k)
3. The bidder is registered in the territory of the Republic of Serbia for at least 10 years and carries out activities in the field of marketing communications in Serbia.
4. The bidder must have at least seven (7) permanent employees who will make the team and who should meet the following requirements:
a) The team leader must have at least ten years of overall work experience in the field of marketing communications; they must be a member of at least one professional international organization in the field of core activities.
b) At least one (1) Master of Science in the field of design that has at least 5 years of work experience in the field of marketing communications.
c) At least two (2) lecturers in higher education institutions in the field of communications who have at least five years of experience.
d) At least two (2) operators who have at least 5 years of working experience, with a university degree in social sciences, psychology (social psychologist and psychologist)
e) At least one (1) graduate engineer of organizational sciences with at least one year of work experience.
5. The bidder has worked on at least five (5) projects, which are the same or similar to the subject of public procurement, whose value is not less than the amount of the given offer, of which at least one (1) for a client who does business in the field of transport – car industry, and that at least one of the projects given in the references has won an award at professional conferences or festivals.

17. Selection among the received bids with the application of the criterion of the lowest offered price is based on the lowest price as the sole criterion.
