The document provides a detailed and clear definition of the concept and scope of Ambush Marketing, analyzing its key characteristics, mechanisms, and potential consequences. It will serve as an important tool for the Advertising Tribunal in making decisions, offering guidelines for assessing the ethics and legality of advertising practices.
In doing so, it will contribute to the consistent enforcement of the Slovenian Advertising Code, which emphasizes fairness and truthfulness in advertising.
“The Ambush Marketing document defines the boundaries between innovative marketing and unethical behavior. It will help companies understand where the line lies between lawful creative approaches and violations of rights. As we at the Slovenian Advertising Chamber have observed an increase in such violations, preparing this document was the logical step. For over 30 years, SOZ has been promoting self-regulation in Slovenia, which, with clearly defined guidelines, helps companies foster a culture of responsible advertising. Self-regulation must be in the industry’s interest, as it reduces the need for strict external regulations and legal disputes, which can damage reputations and incur unnecessary costs,” emphasized Mojca Briščik, Executive Director of SOZ.

This document further strengthens awareness of the importance of ethical standards in advertising, contributing to greater transparency and trust between consumers and businesses.
“After a long period of discussions, various procedures, and conflicting opinions on the actions of individual advertisers, we finally have the first document codifying ambush marketing in Slovenia. In this field, we are even among the first in Europe, which marks a significant step forward. Ambush marketing primarily encompasses practices that harm investors, rights holders, and consumers. Therefore, it is crucial to clearly define such actions. With this document, all stakeholders in the advertising environment now have clear guidelines to assist them in their work,” highlighted Blaž Tomažin Bolcar, founder of the Law Firm Tomažin Bolcar.
The document provides guidelines for advertising practitioners striving to align with ethical standards, ensure accountability to consumers, and respect professional norms. At the same time, it offers a framework for identifying and preventing practices that could undermine trust in the advertising industry and contributes to raising the level of professionalism and integrity in the field of marketing communication.
